A Coastal Walk into Wonder

PLEASE READ CAREFULLY, UNDERSTAND FULLY, AND ASK QUESTIONS IF ANYTHING IS UNCLEAR. MAKE SURE YOU UNDERSTAND THIS WAIVER.

The San Mateo County Parks Foundation’s nature-based wellness programs support participants in cultivating a deep and nurturing connection with the natural world. These programs involve a modest level of physical activity and take place outside in natural and changing environments. Your safe and enjoyable experience of our event offerings is of the utmost importance to us and we describe herein the activities to take place so you are aware of the inherent risks and hazards and can decide for yourself whether to participate.

Nature of Beach Environment

You will be participating in a series of therapeutic activities on a trail near the water’s edge or at the water’s edge. The activities are gentle and creative and take place in a natural coastal environment that presents inherent risks and hazards. 

You understand that by participating in this event, inherent risks and hazards cannot be eliminated through the exercise of reasonable care. This includes but is not limited to:

  • Uneven terrain, sand, rocks, and natural debris
  • Ocean waves, tides, currents, and changing water conditions
  • Marine life and wildlife encounters
  • Weather conditions including sun exposure, wind, and potential storms
  • Limited accessibility for emergency services
  • Lack of lifeguards or safety personnel

You recognize that the Pacific Ocean is very cold and without a wetsuit depletes your energy quickly. You also recognize that you should never turn your back to the ocean. Additionally, you understand that coastal bluffs can be unstable and that you do not sit or walk on the beach directly below bluffs.

Assumption of Risk

You have read this waiver, understand the risks, and agree to assume full responsibility for all risks associated with participating in this event, whether known or unknown, including risks that may arise from:

  • The negligence of other participants
  • Defective or inadequate equipment
  • Weather and environmental conditions
  • Your own actions or inactions
  • Emergency response limitations due to location

Release and Waiver

In consideration for being permitted to participate in this event, you hereby:

  • RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE San Mateo County Parks Foundation, its officers, directors, employees, volunteers, agents, and representatives from any and all liability, claims, demands, or causes of action for personal injury, property damage, or death arising from or related to your participation in this event.
  • INDEMNIFY AND HOLD HARMLESS the above parties from any claims brought by third parties arising from your participation.

Personal Responsibility

You acknowledge that:

  • You are solely responsible for your own safety and well-being
  • You will use appropriate caution and judgment at all times
  • You are physically and mentally capable of safe participation
  • You will follow all stated rules and safety instructions
  • You participate at your own risk and expense

You represent that you have no medical conditions that would prevent safe participation and that you carry adequate insurance coverage for any injuries that may occur.

Binding Effect

This waiver shall be binding upon your heirs, executors, administrators, and assigns. If any portion is deemed invalid, the remainder shall remain in full force and effect.

YOU HAVE READ THIS WAIVER CAREFULLY AND UNDERSTAND THAT IT CONSTITUTES A COMPLETE RELEASE OF LIABILITY.
